What is the impact of key legislation that relates to fulfillment of rights and choices, and the minimizing of risk of harm for an individual with dementia?
Key legislation aimed to minimise the risk of harm while protecting the rights and choices of the individual with the dignity they deserve. It applies to all healthcare services users including patients with dementia. The Human Rights Act can be overruled by the workers if the patient poses serious threat to themselves or others. If they are unable to take a decision for themselves then designated personnel can make those decisions. But these have to be at par with the Mental Capacity Act of 2005. This act states –
1. The patients with dementia have a right to make their own decisions. They must be proven to lack the mental capacity for that to get decisions made by others.
2. The dementia patients have rights to be supported in making decisions.
3. When someone takes decision for them it must be the least restrictive and in their best interest.
