Is the general duty clause

Is the general duty clause so vague and so subject to individual interpretation that companies charged with a violation of general duty can argue lack of notice and therefore due process?

Yes, the general duty clause is vague and subject to individual interpretation –
1. According to the general duty clause, all workers should be treated equally.
2. Employers should ensure the workplace is free from hazards to avoid accidents.
3. Employers should provide safe equipment to workers.
If employers do not obey the general duty clause, they can be charged with a violation of general duty.
